These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("Customer", "User", "you") and Kamakalpa, a sub-brand operated by Ayursanthi Healthcare ("Ayursanthi", "we", "us", or "our"), having its registered operations headquartered in Kerala, India.

By accessing, browsing, registering, or purchasing products on our website (www.kamakalpa.com), you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Shipping Policy, and Cancellation & Refund Policy. If you do not agree with any portion of these Terms, you must discontinue your use of the website immediately.

1. Eligibility and User Representation

By using this website, you represent and warrant that you are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872. If you are under 18 years of age, you may use this website only with the active involvement and consent of a parent or legal guardian.

2. Products and Authentic Ayurvedic Formulations

Kamakalpa offers specialized personal care and wellness products, including the Kamakalpa Ayurvedic Bathing Bar, developed utilizing Ayursanthi's 400-year traditional lineage.

• Product Representation: We make every reasonable effort to display the colors, textures, and packaging details of our products accurately. However, because our formulations incorporate natural botanical extracts and cold-pressed oils, slight variations in natural scent, texture, or color may occur across different batches.
• Ayurvedic & General Wellness Disclaimer: The products, descriptions, and informational materials displayed on this website are intended solely for general personal hygiene, wellness, and self-care. They are not intended to diagnose, cure, mitigate, treat, or prevent any medical condition or disease, nor are they a substitute for advice from a licensed medical practitioner.
• Patch Test Advisory: While our formulations are 100% chemical-free and formulated for gentle application, individual skin sensitivities to natural herbs and botanicals may vary. We recommend conducting a 24-hour skin patch test prior to regular full application.

3. Pricing, GST, and Currency

All product prices shown on the website are quoted in Indian Rupees (INR ₹) and are inclusive of Goods and Services Tax (GST) as applicable under Indian tax laws, unless specified otherwise at the checkout stage.

• We reserve the right to modify prices, introduce discounts, or discontinue products at any time without prior notice.
• In the event of an inadvertent typographical error or system discrepancy in pricing, we reserve the right to cancel or refuse any orders placed for products listed at the incorrect price, and issue a full refund if payment was already deducted.

4. Order Placement, Payment Gateway & Billing

Placing an order constitutes an offer to purchase our products. An order is deemed accepted once payment has been successfully authorized and confirmed by our system, followed by the generation of an Order Confirmation ID.

• Payment Gateway: All online credit card, debit card, UPI, and internet banking transactions are processed safely and securely via Razorpay.
• Supported Payment Methods: We accept:
  • UPI (Google Pay, PhonePe, Paytm, BHIM, and other UPI Apps)
  • Credit and Debit Cards (Visa, MasterCard, RuPay, Maestro)
  • NetBanking across all leading Indian scheduled banks
  • Verified digital wallets and pay-later facilities supported by Razorpay
• Payment Authorization: We do not store or capture your banking credentials or card details. If your payment is declined or fails due to bank authorization errors, your order will not be completed.

5. Order Cancellation, Shipping & Returns

All customer orders, shipping procedures, cancellations, and returns are governed by our dedicated policy documentation:

• Shipping Policy: Standard shipping timeline is 3 to 7 working days across India. Please review our Shipping & Delivery Policy for detailed terms.
• Cancellation Policy: Orders can be cancelled prior to dispatch by emailing info@kamakalpa.com.
• Return & Refund Policy: For hygiene reasons, bathing bars and personal care products can only be returned within 7 days of delivery if received damaged, expired, or defective in original sealed condition. 6. Intellectual Property Rights

All content on this website—including but not limited to brand names ("Kamakalpa", "Ayursanthi", "The Chemistry of Kama"), logos, graphic artwork, text, photographs, product packaging designs, layout designs, audio, video, software code, and icons—is the exclusive intellectual property of Ayursanthi and is protected under Indian and international copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, display, republish, sell, license, or exploit any content from this website without explicit prior written authorization from Ayursanthi.

7. Prohibited User Activities

By using this website, you explicitly agree that you shall not:

• Use the platform for any fraudulent, unlawful, or unauthorized commercial activities.
• Attempt to interfere with the proper working of the payment gateway, website security protocols, or web servers.
• Post false, defamatory, obscene, or infringing reviews, remarks, or content.
• Deploy automated scrapers, bots, spiders, or crawlers to extract content or pricing data without permission.

8. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, neither Kamakalpa, Ayursanthi, its directors, partners, officers, employees, doctors, nor logistics partners shall be liable for any indirect, punitive, special, incidental, or consequential damages resulting from:

• The use or inability to use our products or website.
• Unauthorized access to or alteration of your transmissions or data.
• Any delays, courier disruptions, or failures beyond our reasonable control (Force Majeure events, strikes, natural disasters).

In any event, our total cumulative liability to you for any and all claims arising out of the purchase of products shall not exceed the total purchase price actually paid by you for the specific order giving rise to the claim.

9. Governing Law and Exclusive Jurisdiction

This Agreement, together with all associated policies and transactions executed on this website, shall be governed by, interpreted, and construed in accordance with the laws of India.

In the event of any legal dispute, controversy, claim, or difference arising out of or related to these Terms, the parties agree to first seek an amicable mutual resolution. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the competent civil courts situated in Kerala, India.
